◆ 술자리 말다툼 중 흉기로 2명 공격

전 직장 동료와 술자리에서 말다툼을 벌이다 가위와 젓가락으로 상대를 찌른 50대 남성이 징역형을 선고받았다.

24일 법조계에 따르면 서울북부지법 형사11부(이동식 부장판사)는 살인미수 혐의로 재판에 넘겨진 A씨에게 징역 3년을 선고했다.

A씨는 지난 9월 10일 오후 11시께 서울 강북구 한 주택에서 전 직장 동료 B씨, B씨와 동거 중인 C씨와 함께 술을 마시다 말다툼을 벌였다.

◆ "돈도 없으면서 허세"…수저통·가위·젓가락 휘둘러

A씨는 피해자들로부터 "돈도 없는 사람이 허세를 부린다"는 말을 듣고 격분해 살해를 결심했다. A씨는 주방에 있던 수저통으로 B씨 머리를 내려친 뒤 가위와 젓가락으로 목과 머리, 팔 부위를 수차례 찔렀다.

이어 같은 흉기로 옆에 있던 C씨 목 부위도 수차례 찔렀다. C씨 신고를 받고 출동한 경찰이 범행을 중단시켰다.

◆ 재판부 "죄책 무겁다"…반성·합의 참작해 감형

재판부는 "피고인이 흉기로 피해자들 목 부위 등을 수차례 찌르는 등 범행 수법과 경위에 비춰 죄책이 매우 무겁다"고 판시했다. 재판부는 "살인은 절대적 가치를 지닌 생명을 침해하는 범죄로, 비록 미수에 그쳤더라도 엄히 처벌할 필요가 있다"고 밝혔다.

다만 재판부는 피고인이 범행을 모두 인정하고 깊이 반성하는 점, 우발적 범행으로 보이는 점, 피해자들과 합의해 처벌불원 의사를 밝힌 점, 벌금형 초과 전과가 없는 점을 유리한 정상으로 참작했다.

A man in his 50s who stabbed others with scissors and chopsticks after an argument during a drinking session with former colleagues received a prison sentence.

According to legal circles on December 24, the 11th Criminal Division of Seoul Northern District Court (Presiding Judge Lee Dong-sik) sentenced A to 3 years in prison for attempted murder.

A got into an argument while drinking with former colleague B and C, who lives with B, at a residence in Gangbuk-gu, Seoul, around 11 PM on September 10.

◆ "Showing Off Without Money"…Attacked with Utensil Holder, Scissors, Chopsticks

A became enraged and decided to kill after hearing remarks from the victims that he was "showing off without having money." A struck B's head with a utensil holder from the kitchen, then repeatedly stabbed B's neck, head, and arms with scissors and chopsticks.

A then repeatedly stabbed C's neck area with the same weapons. Police responding to C's report stopped the attack.

◆ Court Rules "Criminal Responsibility is Heavy"…Reduced Sentence Considering Remorse and Settlement

The court ruled, "Considering the method and circumstances of the crime, including the defendant stabbing the victims' neck areas multiple times with weapons, the criminal responsibility is very heavy." The court stated, "Murder is a crime that violates life, which has absolute value, and even though it was only an attempt, severe punishment is necessary."

However, the court considered as favorable circumstances that the defendant fully admitted to the crime and deeply reflected, the crime appeared to be impulsive, the defendant reached a settlement with victims who expressed they do not wish for punishment, and the defendant had no prior convictions exceeding fines.
